Davaar Island Cottages – Terms & Conditions (Scotland)
These Terms and Conditions form the basis of your contract with Davaar Island Cottages. Please read them carefully before making a booking.
1. Your Booking
All bookings are subject to availability. The party leader must be at least 18 years of age and is responsible for ensuring that all members of their party comply with these Terms and Conditions.
Bookings are accepted for holiday purposes only and not for business purposes.
A contract between you and Davaar Island Cottages will exist once we issue written confirmation of your booking.
We reserve the right to refuse any booking prior to confirmation. If we do so, we will refund any monies paid in full.
All bookings are conditional upon Davaar Island Cottages holding a valid short-term let licence in accordance with the Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022. If our licence is withdrawn, suspended or otherwise ceases to be valid, we reserve the right to cancel your booking and will provide a full refund of monies paid.
2. Payment
A deposit of 50% of the total booking cost is payable at the time of reservation.
The remaining balance is due no later than eight weeks before arrival.
For bookings made within eight weeks of arrival, full payment is required at the time of booking.
If payment is not received by the due date, we reserve the right to treat the booking as cancelled and apply the cancellation charges set out below.
Any monies paid are non-refundable except where expressly stated in these Terms and Conditions or where we are able to re-let the property for the same period. In such circumstances, we will endeavour to refund any amount recovered, less any reasonable administration costs.
3. If You Cancel
Cancellations must be notified by the party leader by email or telephone and confirmed in writing.
The following cancellation charges apply:

If we are able to re-let the property for all or part of the cancelled period, we will endeavour to refund any amount recovered, less any reasonable administration costs.
We strongly recommend that guests take out comprehensive travel insurance at the time of booking to cover cancellation, illness, personal belongings and travel disruption.
4. If We Cancel or Change Your Booking
We do not expect to make changes to your booking. However, if we must cancel your booking or make a significant change, we will inform you as soon as reasonably possible.
Where possible, we will offer an alternative property or alternative dates. If this is not suitable or available, we will provide a full refund of monies paid.
Our liability is limited to the amount paid to us for your booking. We are not responsible for any consequential losses, including travel costs, alternative accommodation or loss of enjoyment.
5. Circumstances Beyond Our Reasonable Control (Force Majeure)
We shall not be liable for any failure to perform our obligations where such failure is due to events beyond our reasonable control. This includes, but is not limited to, fire, flood, storm, severe weather, natural disasters, epidemics, pandemics, government restrictions, industrial disputes, interruption of utilities or damage to the property.
In such circumstances, we will refund any monies paid for nights that cannot be provided but will not be liable for compensation or additional expenses incurred by guests.
6. Liability
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot legally be excluded under Scottish law.
We accept no liability for loss of or damage to personal belongings, vehicles or valuables during your stay unless such loss or damage results directly from our negligence.
We shall not be liable for:

Interruption or failure of utilities or services beyond our reasonable control, including electricity, water, internet or transport access to the island;

Temporary inconvenience caused by essential maintenance or repairs;

Any indirect or consequential loss, including travel expenses, loss of enjoyment or alternative accommodation costs.
7. Use of the Property
The property must be used solely for holiday purposes and only by the guests named on the booking.
The property must not be sublet or used for commercial purposes.
Guests agree to keep the property clean and leave it in a similar condition to that in which it was found.
The person making the booking is responsible for any loss, damage or breakages caused by any member of the party or their visitors and agrees to reimburse Davaar Island Cottages for any reasonable costs arising.
Maximum occupancy must not be exceeded and includes infants and children unless otherwise agreed in writing.
We reserve the right, acting reasonably, to refuse entry or require guests to leave if we believe that damage is likely to occur, damage has occurred, illegal activity is taking place, or behaviour is causing nuisance or disturbance. In such circumstances, no refund will be payable.
8. Pets
Pets are only permitted where agreed in advance and confirmed in writing.
A charge of £25 per pet applies unless otherwise stated at the time of booking.
Pets must not be left unattended in the property, allowed on beds or furniture, and must be kept under control at all times, particularly near livestock and wildlife.
Guests are responsible for cleaning up after their pets and for any damage or additional cleaning arising from their stay.
Nothing in these Terms affects the rights of guests accompanied by registered assistance dogs.
9. Arrival, Departure and Access to Davaar Island
Davaar Island is a tidal island and access is restricted to certain times of day. Arrival and departure arrangements are determined by tide conditions and vary throughout the year.
Guests are responsible for arriving at the agreed collection point at the agreed time.
Failure to arrive at the agreed collection time may mean that access to the island is not possible until the next suitable tide. In these circumstances, guests may need to arrange alternative accommodation on the mainland at their own expense and no refund will be made.
Access to Davaar Island may occasionally be affected by adverse weather, sea conditions or other circumstances beyond our reasonable control. We will endeavour to minimise disruption but cannot accept liability for any additional costs incurred.
Guests leave their vehicles on the mainland and are transferred to the island by arrangement. We coordinate arrivals and departures around the tides and transport luggage by 4×4.
Published check-in and check-out times must be observed unless otherwise agreed in advance.
10. Complaints
We want you to enjoy your stay.
If any problem arises during your holiday, you must notify us as soon as reasonably possible so that we have the opportunity to investigate and, where appropriate, put matters right.
If you do not raise an issue during your stay, we may not be able to investigate complaints made after departure.
If the matter remains unresolved, any complaint should be submitted in writing within 14 days of departure.
11. Website Information
Information on our website and in our marketing materials is provided in good faith and is believed to be accurate at the time of publication.
However, descriptions, facilities and information may occasionally change, and we reserve the right to make reasonable amendments.
We are not responsible for the content of external websites linked from our website.
12. Your Rights
Nothing in these Terms and Conditions affects your statutory rights under Scottish law.
